Terms of Service

This English text is provided for convenience. The Japanese version is the authoritative text; if the two differ, the Japanese version prevails.

Article 1 (Application)

  1. These Terms set out the conditions for using the application “MENKO | Japanese Card Flip” (the “App”) provided by KAIMEIDO (the “Operator”), together with its related services (collectively, the “Service”).
  2. You agree to these Terms when you first launch the App, and use the Service on that basis.
  3. Individual explanations and notices that the Operator posts within the App or on this site form part of these Terms.

Article 2 (Definitions)

  1. “Points” means a value that is valid only within the Service and can be exchanged for a Menko Pack.
  2. “Menko Pack” means an item that, when exchanged for Points, yields two Menko cards.
  3. “Maker Ticket” (the “Ticket”) means an item obtained by payment and used to create one Original Menko.
  4. “Original Menko” means a Menko for your exclusive use, with artwork generated by AI from the tags you select.

Article 3 (Account)

  1. On first launch, the Service automatically issues a per-device identifier and uses it to identify you. At this stage we do not ask for your name, email address, or similar details.
  2. To purchase a Ticket, we ask you to link an Apple ID or Google account.
  3. If you unlink your account, your Menko, Points, and Tickets become unavailable.
  4. If you link the same account again within three months of unlinking, the data from before unlinking can be restored. After three months, the data is deleted and cannot be recovered.
  5. Any match in progress at the moment you unlink ends as a resignation.
  6. You are responsible for managing your own device and account. If you lose your device, it fails, or you change devices without having linked an account, we cannot transfer your data.

Article 4 (Points)

  1. You can obtain Points free of charge by watching advertising videos within the Service.
  2. Points cannot be purchased with money.
  3. Points cannot be transferred or lent to other users.
  4. Points cannot be refunded.
  5. Points granted for watching advertisements are subject to a minimum interval and a daily limit on the number of times.

Article 5 (Maker Tickets)

  1. You can obtain one Ticket by paying the price set by the Operator.
  2. For each Ticket, we present three AI-generated artworks, from which you may choose one.
  3. Artwork is generated afresh each time from the tags you select. Even if you select the same tags, identical artwork will not be generated.
  4. We do not re-create artwork you have chosen, and we do not refund Tickets.
  5. Tickets cannot be transferred or lent to other users.

Article 6 (Validity of Tickets and treatment under the Payment Services Act)

  1. Tickets are valid for five years from the date of issue. A Ticket that has passed its expiry date lapses and is not refunded.

  2. Tickets constitute a prepaid payment instrument for own business use as defined in the Payment Services Act of Japan (資金決済に関する法律).

  3. Where the unused balance on a reference date (31 March and 30 September each year) exceeds the amount specified in that Act, the Operator will file the required notification and secure the issue deposit by deposit with the authorities or another prescribed method.

  4. If Tickets become unusable because the Service ends or for another reason, the Operator will carry out refund procedures for unused Tickets as prescribed by that Act. In that case, the Operator will announce the refund method and period within the App and on this site.

  5. You may request the following from the contact point in Article 16:

    • the unused balance of your Tickets
    • the point of contact for complaints and consultation regarding the use of Tickets

Purpose of this Article: A Ticket is money received in advance and exchanged for goods later. So that your payment does not end up in limbo, the law requires the issuer to secure the funds and to provide refunds. The five-year validity exists so that the balance subject to that protection does not accumulate indefinitely — not to extinguish your Tickets early.

Article 7 (Refunds and reversal of payment)

  1. If a refund or reversal of payment is made through an app store, the Tickets obtained by that payment, and any Original Menko created with those Tickets, become unavailable.
  2. The Operator applies the preceding paragraph promptly after confirming the refund or reversal.
  3. If refunds or reversals are made repeatedly, the Operator may suspend your use of the Service.

Article 8 (Original Menko)

  1. An Original Menko may be used only by the user who created it.
  2. It cannot be transferred or lent to other users, or staked in a match.
  3. The name you give it is not shown to other users.
  4. In matches, there is no difference in performance between an Original Menko and an ordinary Menko.

Article 9 (Use of generative AI)

  1. Artwork in the Service is created by generative AI.
  2. To create artwork, the tags you select are sent to the provider of the generative AI.
  3. The Operator reviews generated artwork before providing it. This review may take time.
  4. If the Operator judges that the content is inappropriate, it may generate the artwork again.
  5. If a problem comes to light after release, the Operator may stop displaying that artwork. In that case, one Ticket is returned to you.
  6. Given the nature of generative AI, artwork similar to another user’s may be generated, and the Operator does not guarantee the uniqueness of artwork.

Article 10 (Use by minors)

  1. If you are a minor, please use the Service with the consent of a parent or other statutory representative.
  2. Please purchase Tickets only with the consent of a parent or other statutory representative.
  3. Where you are a minor and a payment was made without the consent of your statutory representative, the matter is governed by the rules of the relevant app store.

Article 11 (Prohibited conduct)

The following are prohibited:

  • using multiple accounts improperly to obtain benefits of the Service more than once
  • deliberately exploiting defects in the Service
  • seeking refunds or reversals of payment for an improper purpose
  • setting a name that causes discomfort to other users
  • analysing or modifying the Service, or using unauthorised programs
  • infringing the rights of the Operator or a third party
  • acting contrary to law or public order and morals

Article 12 (Suspension of use)

  1. If you engage in conduct falling under the preceding Article, the Operator may suspend your use of the Service temporarily or permanently, without prior notice.
  2. The Operator is not liable for damage arising from measures under the preceding paragraph, except where caused by the Operator’s intent or gross negligence.

Article 13 (Change, interruption, and termination of the Service)

  1. The Operator may change the content of the Service.
  2. The Operator may temporarily interrupt the Service for maintenance, in the event of a failure, or for other unavoidable reasons.
  3. The Operator may terminate the Service. In that case, the Operator will give notice within the App and on this site at least 90 days before termination.
  4. On termination of the Service, Points and Menko become unavailable. Unused Tickets are refunded in accordance with Article 6, paragraph 4.

Article 14 (Disclaimer)

  1. The Operator does not warrant the completeness, accuracy, usefulness, or fitness for a particular purpose of the Service.
  2. The Operator is liable for damage caused to you by use of the Service to the extent of ordinary damage arising from the Operator’s non-performance of obligations or tort.
  3. Notwithstanding the preceding paragraph, and except where the Operator has acted with intent or gross negligence, the Operator’s liability for damages is capped at the amount you paid to the Operator in connection with the Service during the 12 months up to and including the month in which the damage occurred.
  4. This Article does not apply where the Japanese Consumer Contract Act or other legislation does not permit the Operator’s liability to be excluded in whole or in part.
  5. The Operator is not liable for damage arising from your communications environment, your device, an app store, or other causes beyond the Operator’s control.

Article 15 (Changes to these Terms)

  1. The Operator may change these Terms without your individual consent where:

    1. the change is in the general interest of users
    2. the change does not contradict the purpose of these Terms and is reasonable in light of the necessity of the change, the appropriateness of the changed content, and other relevant circumstances
  2. When making such a change, the Operator will announce the changed content and its effective date within the App and on this site before that date.

  3. Where a change has a significant effect on you, the Operator may ask for your consent again within the App.

Article 16 (Governing law, jurisdiction, and contact)

  1. These Terms are interpreted in accordance with the laws of Japan.

  2. If a dispute arises between the Operator and you concerning the Service, the Osaka District Court shall be the exclusive court of first instance by agreement.
